Data retention in accordance with the LSSI

EARLYSTART, S.L. informs that, as a provider of data hosting service and pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), retains for a maximum period of 12 months the information necessary to identify the origin of the hosted data and the time when the provision of the service began. The retention of such data does not affect the confidentiality of communications and may only be used in the context of a criminal investigation or for the safeguarding of public security, and may be made available to judges and/or courts or to the Ministry requesting them.

The communication of data to the Forces and Bodies of the State shall be made in accordance with the provisions of the regulations on the protection of personal data.

EARLYSTART, S.L. is the owner of all copyright, intellectual property, industrial, “know how” and all other rights related to the contents of the website www.memimababy.com and the services offered therein, as well as the programmes necessary for its implementation and related information.

The user does not acquire any right or license for the contracted service, on the software necessary for the provision of the service, nor on the technical information monitoring the service, except for the rights and licences necessary for the performance of the contracted services and only for the duration of the contracted services.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from EARLYSTART, S.L., being forbidden to access, modify, visualize the configuration, structure and files of the servers owned by EARLYSTART, S.L., assuming civil and criminal liability derived from any incidence that could occur in the servers and security systems as a direct consequence of a negligent or malicious action on your part.

Intellectual property of the hosted content

The use of services provided by EARLYSTART, S.L. contrary to the law on intellectual property is prohibited, in particular:

The user shall indemnify EARLYSTART, S.L. for the costs incurred by the imputation of EARLYSTART, S.L. in any case for which liability was attributable to the user, including legal expenses and fees, even in the case of a non-final judicial decision.

Protection of hosted information

EARLYSTART, S.L. makes backup copies of the contents hosted on its servers, however it is not responsible for the loss or accidental erasure of the data by users. Similarly, it does not guarantee the total replenishment of the data deleted by users, since the aforementioned data could have been deleted and/or modified during the period of time elapsed since the last backup.

The services offered, except the specific backup services, do not include the replacement of the contents preserved in the backups made by EARLYSTART, S.L., when this loss is attributable to the user; In this case, a fee will be determined according to the complexity and volume of the recovery, provided the user accepts it.

The replacement of deleted data is only included in the price of the service when the loss of the content is due to causes attributable to EARLYSTART, S.L..

Commercial communications

In application of the LSSI. EARLYSTART, S.L. will not send advertising or promotional communications by email or other equivalent electronic means of communication that previously have not been requested or expressly authorized by the recipients of the same.

In the case of users with whom there is a prior contractual relationship, EARLYSTART, S.L. is authorized to send commercial communications concerning products or services of EARLYSTART, S.L. that are similar to those that were initially contracted with the customer.

In any case, the user, after proving his identity, may request that no more commercial information be made available to him through the channels of Customer Service.
